Equality and rights for all
The Constitution of Colombia prohibits discrimination, which means that all individuals, whether single or part of heterosexual or same-sex couples, have the right to participate in the surrogacy process, as long as there is a genetic link to the baby. This equality of rights was recognized by the historic decision of the Constitutional Court of Colombia in 2015.
We extend this equality of rights internationally. Article 100 of the Colombian Constitution grants foreigners in Colombia the same civil rights and guarantees given to citizens. This includes the right to participate in international surrogacy in Colombia.
